Clearfield man charged in Roy woman's rape

ROY — A female from Roy was celebrating her 21st birthday at a party on June 22 when she fell victim to sexual assault, police said.
After becoming overly intoxicated, the victim began throwing up profusely before being placed into a bed.
“She did not have any control of herself to include not being able to walk or talk,” said the incident report.
That’s when acquaintance Christian Galvan, 24, meet with her in bed, officers said.
"They knew of each other, but didn’t quite know each other,” said Roy police spokesman Matt Gwynn.
According to the report, the Clearfield suspect went up to the bedroom, removed the victim’s shorts and underwear and had sexual intercourse with her.
“The victim said that she repeatedly shook her head no in attempts to communicate with Christian that she was not consenting to the sexual conduct,” the report said.
On June 23, the victim entered the Roy Police Department to disclose the incident. On Tuesday, authorities arrested Galvan on one count of rape, a first-degree felony, and one count of forcible sodomy, also a first-degree felony.
Police said Galvan admitted to having sexual intercourse, but said it was consensual.
"According to witnesses the victim was completely incapable of providing consent,” Gwynn said.
