This is a round-up of new charges and ongoing proceedings in Weber and Davis county courts for the week of June 12, 2017
David Russell Erekson will undergo a competency review before his case in Ogden’s 2nd District Court will proceed, Judge Joseph M. Bean ordered during Erekson’s hearing last Thursday. Erekson is charged with one count of murder, a first-degree felony, in connection with the May 10 death of Roger Haven, 69, of Huntsville. He is also charged with obstruction of justice, a second-degree felony; domestic violence assault, a class A misdemeanor; and interference with arresting officer, a class B misdemeanor.
Michael Allan Martin, 51, was charged with possession or use of a controlled substance (with prior convictions), a third-degree felony; three counts of possession of a controlled substance with intent to distribute, first-degree felonies; and possession of drug paraphernalia, a class B misdemeanor. On March 29, Martin’s storage shed was searched by members of the Weber Morgan Narcotics Strike Force, where they found heroin, methamphetamine and marijuana, according to probable cause documents. On June 6, Martin was driving on 475 North when he was stopped by a narcotics strike force member and admitted to carrying a “ball” of methamphetamine. Martin has twice been convicted of drug distribution offenses and spent four years in prison or on parole between 2010 and 2014.
Joseph Ray Valdez, 31, was charged with possession of a dangerous weapon by a restricted person, a third-degree felony; assault against a police officer, a class A misdemeanor; interference with an arresting officer, a class B misdemeanor; possession of drug paraphernalia, a class B misdemeanor; and failure to stop at the command of a law enforcement officer, a class A misdemeanor. Court documents said Weber Morgan Narcotics Strike Force members recognized Valdez as having an active felony no-bail warrant for a parole violation when they attempted to stop Valdez on 1200 Monroe Blvd. on May 31. Valdez attempted to flee on foot and, when apprehended, struck an officer in the face, police said. He was allegedly carrying a knife and used hypodermic needles.
Jon Tayla Eugene Zimmer, 26, was charged with rape of a child, a first-degree felony; sexual abuse of a child, a second-degree felony; sexual exploitation of a minor, a second-degree felony; four counts of unlawful sexual activity with a minor, third-degree felonies; failure to stop at command of law enforcement officer, a class A misdemeanor; and assault against a peace officer, a class A misdemeanor. Charging documents said that an underaged female reported sexual activity with Zimmer on several occasions in May and June of this year. Zimmer was located during a traffic stop and attempted to flee, pulling a “football move” on the arresting officer, striking the officer’s chest and shoulder, police said.
Esteban Mendez, 30, was charged with two counts of kidnapping, second-degree felonies; failure to respond to an officer’s signal to stop, a third-degree felony; false personal information to a peace officer, a class A misdemeanor; driving under the influence of alcohol or drugs, a class B misdemeanor; reckless driving, a class B misdemeanor, and open container in vehicle, a class C misdemeanor. Layton police said that on June 10, Mendez’ vehicle was stopped for a broken brake light. Mendez, who had two female passengers riding with him, allegedly gave a false name and false social security number before speeding away and crashing. Police said that the female passengers told Mendez to let them out of the vehicle during the chase, but he refused.
Arthur Louis Porter, 19, was charged with enticing a minor, a second-degree felony; and three counts of dealing in harmful material to a minor by an adult, third-degree felonies. A Davis County Child Exploitation Task Force member said that beginning on June 6, Porter engaged in sexually explicit conversations with an undercover officer that he believed was a 13-year-old girl. Police said Porter was arrested when he arrived in Farmington to meet for sex with the underage profile.
