Miranda rights in question in capital homicide case

OGDEN — A judge has taken under advisement a suppression motion that claimed Miranda flaws should negate Jeremy Marshall’s admissions to police about his role in the death of his girlfriend’s daughter.

Marshall, 36, is charged with capital homicide in the Dec. 14, 2011, death of the 3-month-old infant. But prosecutors have opted not to seek the death penalty, which means Marshall faces, if convicted, sentences of life in prison, or life in prison with the possibility of parole.

Judge rejects Stewart defense claim that death penalty is unconstitutional

OGDEN — A judge has rejected a defense motion calling for the death penalty to be declared unconstitutional.

Filed as part of the run-up to Matthew David Stewart’s trial in a police shooting, it is the first of several constitutional challenges expected in any death penalty case.

Stewart is charged with capital homicide in the Jan. 4, 2012, police pot raid gone bad that left officer Jared Francom dead and five other officers and Stewart injured.

Ben Lomond’s ex-swim coach to learn fate April 12 in sex abuse case

OGDEN — Setting aside their prior arguments about civility, the prosecution and the defense scheduled a new sentencing hearing for the former Ben Lomond High School swim coach convicted of sexual relations with one of her swimmers.

“The state sees this request for a continuance as a tactic to further delay the imposition of a sentence in this case,” Deputy Weber County Attorney Teral Tree wrote in a motion objecting to the cancellation of Jamie Waite’s sentencing hearing, which had been set for today.

The case has gone on for more than two years with four different trial dates before trial finally began in February, Tree noted.

Civil suit on swimmer’s death to address her alleged near-misses

OGDEN — The next court trial in the fatal boating accident on Pineview Reservoir may not resemble the first two.

Last month’s sentencing of the second and third defendants in the Aug. 21, 2011, death of swimmer Esther Fujimoto ends the criminal prosecution. A wrongful death civil lawsuit against the three young men awaits in the same Ogden 2nd District Courthouse.

The criminal charges were about what happened after the collision, where Skyler Shepherd, Colton Raines and Cole Boyer were convicted of leaving her to die. The civil suit is about the collision, and she may be partially liable, the defense contends.

Stewart files motion to suppress search warrant that allegedly led to shootout

OGDEN — Matthew David Stewart’s defense team has filed a motion to suppress the search warrant that led to a deadly shootout with police at his home on Jan. 4, 2012.

The 142-page motion would only apply to the 16 marijuana plants seized by police after five officers were wounded and Agent Jared Francom killed, for which Stewart now faces the death penalty.

OGDEN — The defense has filed the long-awaited bid to suppress Doug Lovell’s sworn 1993 testimony from the stand describing how he killed a South Ogden woman.

Lovell was sentenced to death after that hearing, in which he detailed strangling Joyce Yost.
