SALT LAKE CITY -- The Utah Supreme Court is deciding whether a coal-fired power plant in central Utah should use the latest pollution-control technology.
Opponents of the plant also are fighting construction, saying the plant's air-pollution license issued four years ago has expired.
Sevier Power Co. says it will voluntarily use the latest pollution-control technology for the 270-megawatt plant. It also says it doesn't need a new license.
The court on Wednesday ordered Sevier County officials to put a referendum on the ballot that would give citizens more say on whether the plant is built in the town of Sigurd.
