BOUNTIFUL -- Although the parents of a victim wanted the sentencing hearing of a former drama teacher to be held in October, the judge set it for November,
Judge Thomas L. Kay set Nov. 10 for a sentencing hearing for Jeremy Page Flygare, 33, of Sunset.
Flygare pleaded guilty to two counts of second-degree felony aggravated sexual abuse on Friday in 2nd District Court. A three-day jury trial, which was to begin Sept. 19, has been canceled.
Flygare was hired in August 2007 as a theater teacher for Northridge High School. He has since been terminated.
Flygare's attorney, Kenneth Brown, said he would prefer a November sentencing hearing because Flygare is "in intensive outpatient treatment." Brown said that treatment could offer some options for the judge.
Brown also said he will recommend Flygare serve probation rather than prison, even though prosecutors will be recommending Flygare serve concurrent prison terms.
Flygare could be sentenced to serve one to 15 years in the Utah State Prison on each conviction.
Deputy Davis County Attorney Cristina Ortega said, "We would like the sentencing hearing as quickly as possible."
The parents of the victim were in court, but the victim was not.
The mother said in court, "We prefer October." The parents wanted the sentencing completed as soon as possible.
Ortega also asked Kay to remind Flygare that he could have no contact with the victim.
Ortega said her office received a report that Flygare had gone to the girl's work site and, although he saw her there, he did not leave.
"You're to have no contact," Kay said. "Don't go where she works. If you go somewhere and see here, you are to go away."
Flygare was originally charged with three counts of first-degree felony rape. Flygare was arrested by Layton police in May of 2010 after a month-long investigation. Police said they received a tip on March 31, 2010, about a possible inappropriate relationship between Flygare and the female student.
When interviewed, the girl told police she and Flygare had been intimate 10 to 15 times and also had sexual intercourse at the school.
According to the "statement of defendant in support of a guilty plea" document filed in 2nd District Court, which Flygare signed before he entered his pleas, he admitted to touching the genitals of the 17-year-old girl at least twice between Sept. 1, 2009, and March 26, 2010.
He also admitted: "Because I was her teacher, she couldn't consent," according to the document.
