Slain BYU prof's family sues over arrest, prosecution

SALT LAKE CITY -- The son and daughter-in-law of a slain Brigham Young University professor are suing Utah County police and prosecutors over their wrongful murder indictment for his death.

Attorneys for Roger and Pamela Mortensen contend the couple's constitutional rights were violated by the Utah County Sheriff's Office and the Utah County Attorney.

The lawsuit was filed Monday in U.S. District Court in Salt Lake City.

Kay Mortensen was found dead with his throat slit in his Payson home in November 2009.

Roger and Pamela Mortensen found him and called 911. Eight months later they were charged with his murder.

Prosecutors dropped the charges last December after two Vernal men were found with guns taken from Kay Mortensen's home.

A comment from Utah County Attorney Jeff Buhman was not immediately available.
