3rd competency evaluation sought in Centerville shooting over 'telepathic rape'

FARMINGTON -- The results of a third evaluation are expected to show whether Michael L. Selleneit is competent to stand trial for shooting his neighbor.

Selleneit, 52, of Centerville, appeared before Judge Thomas L. Kay on Thursday. However, prosecutors could not proceed with the case because of conflicting results from two competency evaluations.

"One said he is not competent to proceed and the other said he is," Kay said. "So where do we go now?"

Julie George, Selleneit's attorney, suggested a third evaluation from the state hospital be taken before proceeding.

"We've done that before and we'll do it again," said Deputy Davis County Attorney Jason Nelson.

Selleneit is charged with one count of first-degree felony attempted murder and second-degree felony possession of a firearm by a restricted person.

According to the probable cause affidavit, Selleneit told officers he shot Tony R. Pierce, 41, who lived next door, on Oct. 30, 2011, because Pierce had been "telepathically" threatening to kill him.

He also said, "Pierce has telepathically raped his wife on many occasions," according to the court document.

Selleneit's wife, Meloney Toone Selleneit, also appeared in court on Thursday. In December, she pleaded not guilty to charges that she played a role in the shooting.

Her defense attorney, Todd Utzinger, said he is no longer representing Meloney Selleneit and Rich Gallegos will take over her defense. She will be back in court on Feb. 9.

Meloney Selleneit, 53, is accused of telling her husband to shoot Pierce. She is charged with one count of first-degree felony criminal solicitation and a second-degree felony charge of purchase, transfer or possession of a firearm by a restricted person.
