Sentencing in W. Bountiful safe theft delayed after report mix up

FARMINGTON -- The defendant was ready to be sentenced. His attorney and the prosecutor were ready to go forward with the sentence.

The victim, Gary Turley, was also in court.

But Judge David Connors recommended the sentencing hearing be continued until the attorneys and the defendant, Steven Kent Hogge, all have a chance to review the pre-sentence report.

"The recommendation is different from the prosecutor's statements," said Connors, who had a copy of the pre-sentence report.

Connors set Feb. 14 for another sentencing hearing, in order for both sides to have time to receive the report and review it.

Both Defense Attorney Mark Arnold, and Deputy Davis County Attorney Steve Major agreed they had not received a copy of the report from Adult Probation and Parole.

Major said he was comfortable with going forward with the sentencing hearing, due to an agreement between his office and Arnold when Hogge had entered his guilty plea.

But based on the recommendation from Connors, Arnold asked that he has time to get a copy of the report written by AP&P and review it.

No one from AP&P was in the courtroom for the hearing on Tuesday to answer the attorneys' and judge's questions about where the report was.

Hogge, 41, entered a guilty plea on Dec. 20, 2011 to burglary, a third-degree felony.

Hogge was originally charged with a second-degree felony theft and a second-degree felony burglary.

Hogge, along with several other defendants, took part in stealing a safe that contained almost $200,000 out of Turley's West Bountiful home in September.

Two other defendants, Joshua Cameron Watts, 19, of West Valley and Wayne Jerry Clark, 24, are also charged in the case. Both are charged with second-degree felony theft and second-degree felony burglary.

Watts is scheduled to be in court on Feb. 7. Clark's next court hearing is set for Feb. 21. Both have pleaded not guilty to the charges.
