Preliminary hearing slated for Millerberg

OGDEN -- A preliminary hearing on charges against Eric Millerberg related to the death of Alexis Rasmussen has been set for a full day, April 9.

Millerberg is charged with child abuse homicide in the Sept. 11 death of the 16-year-old Rasmussen. Her body was found Oct. 18 in Morgan County.

Millerberg is also charged with obstruction of justice, unlawful sexual contact and abuse or desecration of a body, the latter related to hiding the body.

His wife, Dea Millerberg, is also charged with that offense and will be arraigned next week.

A preliminary hearing ensures that evidence meets the legal standard required to advance a case to trial.

Scheduling the hearing by phone last week canceled a status conference set for today for that purpose.

Public defender Randall Marshall said as soon as he was appointed Eric Millerberg's lawyer on Jan. 31, it was in his client's best interest to schedule the preliminary hearing as soon as possible.

The April 9 date on Judge Scott Hadley's calendar was the soonest available full day, he said.

Millerberg is currently in prison on unrelated probation violations for using drugs.
