2. Discuss and vote to alter city procedure that currently only allows two council members to serve on a committee. Vote to allow any council member to serve on a committee that desires to do so.

3. Discuss disproportionate fees for businesses.

4. Discuss an awning issue that residents Mr. & Mrs. DeLasilva have. Allow Mr. DeLasilva to explain his dilemma.

Wade is right - he should be discussing Item 14, and Justin should be discussing Item 15. I will make that correction during the meeting.

 

As items were added to the agenda and it became longer and longer, hence increasing the meeting time to longer and longer, I placed the disproportionate fee item on the February 14 agenda. So, it's not been deleted or ignored, just postponed.

I would like this agenda corrected on the agenda for tonight as well as on the website for the packet.

 

I also want Annette's memorandum to item #14 corrected for the website packet. It says it was requested by "a council member". Why is no name included, but then a different council member's name is included later in the same memorandum? I will always take responsibility for what I put on the agenda, so why my name is not on it I don't know. The maximum of 2 council members being changed/removed is the reason I put this on the agenda. In fairness to Justin, he should not be held responsible for this item by having his name on this memorandum since he is not the one responsible for putting it on the agenda. Each of us will be responsible for what we put on each agenda.

By the way, FYI: I am NOT putting a motion forward tonight to change your medical benefits. That is not my intent. Some employees it appears may have jumped to inaccurate conclusions by making assumptions.

As part of the discussion on committees, I would appreciate it if staff would come prepared to advise us on the Utah Open & Public Meetings Act and if there is anything we need to do to comply with that if we have three or more council people on a committee--are we in compliance just for noticing and holding open meetings of that committee, or do we need to advertise that it's now a City Council meeting; would we need to only have two that are voting members and the others in an advisory capacity only; is there a list of things that if we keep committee business to that we will still be in compliance, etc. I've been reading it (http://le.utah.gov/~code/TITLE52/52_04.htm) and none of those questions are clear to me.

I've spoken with the mayor about this. We are in compliance.

 

You might be interested in a Standard Examiner article in I believe yesterday's newspaper. It gave thumbs up or down to several things. One thumbs down was to cities having a couple of city council members serve on committees, rather than allowing a quorum to be present. It says that if a quorum is allowed to be present then it ensures compliance with the Open & Public Meetings Act. I agree.
