FARMINGTON -- A man charged with aggravated assault and aggravated robbery may end up facing federal charges within a month, prosecutors say.
Michael Rivera, 31, appeared Monday in 2nd District Court before Judge John R. Morris.
Rivera is charged with two first-degree felonies stemming from the Aug. 29, 2009, botched robbery and shooting of Anmol Ratton in his driveway in Clearfield.
Rivera has been held in Davis County Jail in lieu of $100,000 bail since his arrest Dec. 17, 2009, on the robbery charges.
Deputy Davis County Attorney Steve Major said the FBI is investigating Rivera for communication fraud and identification fraud.
A three-day jury trial, which had been set to run April 4-6, has been canceled.
Major said Rivera's attorney, Ronald Fujino, asked to continue the state case until the FBI has concluded its investigation. Major said it may take a month before any federal charges are filed.
"We are prepared to go forward with trial," he said. "Our witnesses are prepared to testify."
Rivera was one of three brothers charged in the Clearfield case. The other two, Ramon Rivera and Daniel Rivera, are serving prison sentences for the Clearfield robbery and for other charges.
Ramon Rivera, now 26, is serving five years to life in prison on one count of attempted murder, a first-degree felony. That charge was from the Clearfield 2009 shooting.
He also is serving 57 years on federal charges for three counts of robbery, possession of a firearm by a convicted felon, possession of a firearm with an obliterated serial number and three counts of brandishing a firearm during a crime of violence.
Those charges stem from other 2009 robberies in Davis County.
The third brother, Daniel Rivera, 32, is serving a sentence of up to five years in prison for third-degree felony escape from official custody. That charge stems from when he left Weber County Jail on Aug. 4 while serving sentences on the Clearfield case and on a charge out of Weber County.
Daniel Rivera had pleaded guilty March 31, 2011, to wrongful appropriation and reckless endangerment, both class A misdemeanors, in connection with the Clearfield shooting.
He then failed to show up for his sentencing hearing in May 2011.
Daniel Rivera is considered a person of interest in the disappearance of Victor Flores, 25, of California.
Flores' body was found buried in the yard of Sarah Nichole Munn, of Roy. Police said Munn is a girlfriend of Daniel Rivera. Police said Daniel Rivera rented a tractor and dug a hole in Munn's yard in May 2011.
Munn has been charged with second-degree felony obstruction of justice in 2nd District Court in Ogden.
