CLEARFIELD -- A new agreement will start July 1 regulating the collection of impact fees for North Davis Fire District.
The city, West Point and the North Davis Fire District entered into an original interlocal agreement July 1, 2005. This agreement was meant to memorialize what the parties intended regarding establishing the agreement, according to the city resolution.
Both Clearfield and West Point currently are collecting impact fees for the district, but the agreement in place does not address impact fee collection. Because of this, the approved resolution states, all parties want to clarify this issue.
To do this, a section was added to the agreement regarding impact fees.
It states that Clearfield and West Point will collect impact fees for construction of single-family residences and will forward those to the district. However, for commercial, industrial and multifamily impact fees, the district needs to compute the fees, while the cities will collect the fees for the district.
The agreement makes it clear that the district is solely responsible and liable for computations of the fee amount.
Other general items were added as well, stating, for example, that the cities are only intermediaries to receive fee payments and do it solely for convenience of those paying the fees. Neither city is liable, according to the agreement, for any errors or mistakes in fee amounts.
The Clearfield City Council recently unanimously approved the agreement.
