OGDEN -- A three-day preliminary hearing for Matthew David Stewart was set for Oct. 31-Nov. 2 during a brief court appearance today.
Stewart appeared before 2nd District Judge Noel Hyde.
Prosecutors and defense attorneys told Hyde they received ballistics reports from the state crime lab on Friday.
After the hearing, prosecutors declined any comment on the ballistics reports.
Defense attorney Randy Richards said he had not yet reviewed the reports, but probably would not be offering any comment, since they are evidence in his client’s case.
Stewart faces multiple charges, including capital homicide which could result in the death penalty, in a Jan. 4 shootout with drug agents at his home.
Ogden police officer Jared Francom died from his wounds and five other officers were wounded.
