SALT LAKE CITY -- A federal judge has dismissed a lawsuit filed by the son and daughter-in-law of a slain Brigham Young University professor over their wrongful arrest and indictment.
Roger and Pam Mortensen spent about five months in jail after a grand jury indicted them of murdering Roger Mortensen's father, Kay Mortensen, at his Payson-area home in November 2009.
But The Salt Lake Tribune reports U.S. District Judge Dale Kimball on Monday dismissed the couple's lawsuit filed against Utah County police and prosecutors.
His action came after the U.S. Supreme Court ruled in a separate case last April that grand jury witnesses have absolute immunity from claims based on their testimony.
After dismissing the indictment against the Mortensens, prosecutors filed murder charges against Martin Bond and Benjamin Rettig in the case.
