SALT LAKE CITY — The family of an 11-year-old boy who was fatally mauled by a black bear argued before the Utah Supreme Court that the state had a duty to protect the boy.
The Ives family set up camp at the Timpooneke Recreation Area in American Fork Canyon on Father’s Day 2007. They didn’t know the camp site had been abandoned earlier that day because of a bear attack.
State workers had unsuccessfully searched for the bear. The family contends those workers should have warned them.
Sam Ives was asleep when the bear sliced through his tent, pulled him out and killed him.
The Salt Lake Tribune reports state attorney Peggy Stone argued in court Thursday that the workers didn’t have that duty because the camp site is on federal land.
