Lawsuit filed in Logan ER sex assault on patient

LOGAN -- A man who says he was sexually assaulted by an emergency room technician is suing Logan police for failing to stop it.

The Herald Journal reports that a Logan police officer was assigned to guard the man, who was in a hospital for treatment for intoxication.

Logan City Attorney Kymber Housley tells the newspaper the officer stopped the unwanted sexual act and the lawsuit has no merit.

The emergency room technician, 46-year-old Hal Weston, faces a May 9 trial for allegedly performing oral sex on the unconscious patient behind a curtain.

Weston no longer works at Logan Regional Hospital.
