Man shot at by Layton homeowner pleads guilty to burglary

FARMINGTON -- The man identified as coming out of Clare B. Niederhauser's home in January recently entered a guilty plea to a reduced charge.

Robert Santos Cruz, 47, of Layton, entered a guilty plea to a third-degree felony burglary charge in 2nd District Court on March 7.

He was originally charged with second-degree felony burglary and class B misdemeanor charge of criminal mischief.

A sentencing hearing is set for April 11 before Judge Thomas L. Kay.

The co-defendant, Yolando Gonzales, who is charged with second-degree felony burglary and class B misdemeanor charge of criminal mischief, has a court hearing on April 10.

Niederhauser pleaded no contest to illegal discharge of a firearm, a class B misdemeanor, in February in 2nd District Court. He had shot his handgun into a field and at a fleeing car when police arrived at Niederhauser's home.
