OGDEN -- Trial dates were affirmed Tuesday morning for Eric Millerberg in the murder of his 16-year-old baby sitter.
Trial is set to begin Feb. 10 before 2nd District Judge Scott Hadley.
Millerberg is charged with child abuse homicide in the October 2011 drug overdose death of 16-year-old Alexis Rasmussen in Millerberg's North Ogden home.
The teen had taken to partying with Millerberg and his wife Dea, also charged in the death as an accomplice.
Tuesday morning, Weber County Attorney Dee Smith requested a cut-off date for any pre-trial defense motions, which Hadley set for Jan. 10.
Millerberg is also charged with unlawful sexual contact for an alleged sexual relationship with Rasmussen. The case has long been delayed by laboratory testing and forensic details, plus an unsuccessful change of venue motion sought by the defense due to the extensive publicity around the case.
Rasmussen's was a well-publicized missing person case for almost a month before her body was found hidden in a remote Morgan County location.
