OGDEN -- Burglary charges have been dismissed against two men after their alleged violations boiled down to a misunderstanding over salvage rights.
Mitchell Maw, 39, and Brandon Layne, 38, were arrested Feb. 19 at the demolition site of the Travel Lodge Motel on Washington Boulevard, suspected of unlawfully removing copper wiring from the motel.
Police said they found the two in possession of 60 feet of bundled copper wiring they believed they took from the site, which is surrounded by fencing and "no trespassing" signs.
A caller had reported the men as trespassers.
Charges against both men were dismissed March 29, according to court records.
Maw's public defender, Martin Gravis, said the dismissal came after the owner of the building was finally contacted to confirm what Maw and Layne had been saying, that they had permission to salvage material at the motel site.
