OGDEN -- The city has asked the Ogden Records Review Board to reconsider its decision ordering a list of prospective donors for a proposed $40 million field house be released to local activist Dan Schroeder.
Schroeder was initially denied the list by the city as part of a request under the Government Records Access and Management Act.
Schroeder appealed the denial, and the records review board determined the list should be released because private fundraising does not qualify as a procurement procedure under state law.
Assistant City Attorney Mara Brown argues in a motion for reconsideration that the donor list does not fall within the definition of a record under GRAMA because it is a personal note prepared by Mayor Matthew Godfrey.
Schroeder said in a written response there isn't a provision in GRAMA or in city regulations allowing Brown to submit a motion for reconsideration. The city also hasn't provided any new factual evidence, he said.
