Weber County Attorney: Warrant in Ogden cold case sealed to keep element of surprise

OGDEN — An arrest warrant for Stephen Phillip Ellenwood, accused of the 1993 homicide of a 92-year-old Ogden woman, had been sealed to protect another victim and witnesses, according to court documents

Weber County Attorney Dee Smith explained why the warrant was kept under wraps in an affidavit unsealed Friday.

“Stephen Ellenwood is currently not in custody and does not know that his DNA profile matched the DNA taken from the deceased’s home and another victim,” Smith wrote in the affidavit that was sealed along with the arrest warrant on April 26.

“He also does not know that his fingerprints match those taken from the deceased home. Releasing this information prior to service of the arrest warrant would provide an advantage ... to learn what the police now know and to abscond or evade apprehension. It may also endanger the other victim and other witness.”

Also, if the arrest warrant hadn’t been sealed, the case likely would have been reported by the media, which may have alerted Ellenwood, Smith said.

Arrest recalls memories of Ogden woman who died on Mother’s Day in 1993

OGDEN — The family of the 92-year-old woman killed in the 1993 homicide in which police after 20 years have arrested a suspect wants the public to know she wasn’t just a victim in a cold-case file. In fact, they say, she was just the opposite.

Grace Mae Odle was a strong woman who never failed to rise up to meet the challenges in her life, including the one that resulted in her death, her family says.

“She was about 5 feet tall and very meek, very soft,” Odle’s grandson, Bruce Odle, 59, said in a phone interview. “But she was very strong, both in her standards and her beliefs. She was just that kind of person.”

Idaho inmate’s attempt to fight extradition to Weber County on shaky legal ground

OGDEN — Idaho inmate Gregory Seamons will likely have difficulty blocking extradition to Weber County to stand trial in the 1983 rape and slaying of 11-year-old Rebecca Lemberger, says a lawyer.

“There are very narrow legal arguments he can raise,” said Idaho Deputy Attorney General Bill Loomis. “It’s pretty hard in these types of cases to be successful to stop extradition. His (Seamons’) argument about the case needs to be made in Utah and not in Idaho.”

Seamons has told an Idaho judge he will fight extradition because a DNA sample taken from him in 2011 by Ogden police at the Valley County Jail in Idaho was done in dirty conditions.

Convicted rapist appeals to Idaho governor, says DNA test by Ogden officials faulty

BOISE — An Idaho inmate accused of the sexual assault and beating death of an 11-year-old Ogden girl two decades ago claims the DNA test that identified him as a suspect is faulty.

Gregory Seamons told a judge Tuesday he has proof that the DNA sample taken in 2011 by Ogden police at the Valley County Jail in Idaho was done in dirty conditions. Seamons said he wants Idaho Gov. Butch Otter to know about the flaw with the test.

If that doesn’t sway the governor, Seamons said he will file a writ of habeas corpus with the district court, meaning he will fight extradition. If that happens, it could be months before Seamons is brought to Utah, where he is charged with first-degree aggravated murder and rape in the 1983 slaying of Rebecca Lemberger.

Seamons hearing in Boise rescheduled

OGDEN — An arraignment hearing for Idaho inmate Gregory L. Seamons that was to take place today in Boise for the 1983 rape and slaying of 11-year-old Rebecca Lemberger of Ogden has been postponed because of a judge’s scheduling conflict.

The new date for the hearing at the Idaho Correctional Center will be April 2.

Paperwork to extradite Seamons in Ogden cold case on its way to Idaho

OGDEN — Formal paperwork has been filed to begin the process of returning Gregory L. Seamons to Ogden to stand trial in a cold-case murder and rape police say were solved by DNA testing.

Seamons, 45, is charged with rape and murder in the 1983 death of 11-year-old Rebecca Lemberger, of Ogden.

Seamons has been an inmate at the Idaho State Correctional Institution in Boise since 2007 following a conviction for second-degree kidnapping. He is scheduled to complete his sentence in December 2017.

Crime lab says Seamons' DNA claim 'doesn't make sense'

OGDEN — The head of the Utah State Crime Lab says it would be almost impossible for a father’s DNA to be confused with that of his son.

Jay Henry said lab policies prohibit him from commenting directly on his lab’s DNA testing, which police say has tied Greg Seamons to the murder and rape of an 11-year-old Ogden girl in 1983.

So he couldn’t speak directly about Seamons’ claim in a letter to The Salt Lake Tribune that his late father likely committed the crime.

SALT LAKE CITY — An Idaho inmate facing extradition for the 1983 sexual assault and beating death of an 11-year-old Ogden girl says his father may have committed the murder, a newspaper reported Thursday.

OGDEN — Idaho inmate Gregory L. Seamons, named by Ogden police as the prime suspect in the 1983 abduction, rape and homicide of 11-year-old Rebecca Lemberger, has portrayed himself online as an artist fond of drawing delicate pictures of peacocks, hearts and butterflies.

Until last week, Seamons’ sketches were available for sale on the Fine Art America website, www.fineartamerica.com, which helps artists market their work.

However, soon after being charged Sept. 28 by Weber County prosecutors with rape and first-degree murder in the cold-case slaying of Lemberger, his photo, autobiography and sketches were removed from the site.

Man won't face execution in 1983 cold-case rape, murder of Ogden girl

OGDEN — Greg Seamons is charged under the 1983 version of Utah’s death penalty statute, but he will not face execution if he is convicted of the rape and murder of 11-year-old Rebecca Lemberger.

Seamons, 45, is charged with murder in the first degree and rape in the March 1983 death of the Ogden girl.

Police are assembling a timeline for Lemberger, from her disappearance March 2, 1983, when she left home to walk to Edison Elementary School at 935 E. 1050 North, to the discovery of her body the next day in a shed west of 729 N. Mountain Road in Ogden. She had been beaten to death.

Longtime letter writer to suspect in 1983 Ogden murder feels 'deceived'

OGDEN — From his cell at the Idaho State Correctional Institution, Gregory L. Seamons wrote last month to an Ogden woman about soon being paroled after being in prison for second-degree kidnapping since 2007.

The neatly penned two-page letter makes no mention that he had already been interviewed by Ogden detectives, who, through DNA evidence, were closing in on him as the prime suspect in the 1983 abduction and slaying of 11-year-old Rebecca Lemberger.

“My parole date was for July 5 but I went past that date because I had three classes to complete,” Seamons wrote Sept. 18 to the woman, who has been corresponding with him for more than two decades and asked not to be identified. “I graduated (from) the last one today so I should be out in 14 days or so.”

However, the Idaho Department of Correction website indicates Seamons’ last parole hearing was in March and that he is scheduled to complete his sentence in December 2017.

Pain resurfaces for family, friends as Ogden police pin down suspect in cold case

OGDEN — A warrant charging an Idaho Correctional Institution inmate with the 1983 murder of 11-year-old Rebecca Lemberger has revived a lifelong family tragedy for Denise Lemberger Foran.

Foran, Rebecca Lemberger’s cousin, said her entire family has spent the last 29 years thinking Rebecca’s adoptive father, her uncle Frank, was responsible for Rebecca’s death. Many members of the family died thinking Frank killed his daughter, she said.

Police now say he didn’t.
