Guilty verdicts in Pineview boating death trial

OGDEN — A 2nd District Court jury found Colton Raines and Robert Cole Boyer guilty Thursday night of misdemeanor charges in the death of Esther Fujimoto.

Fujimoto was struck by a powerboat driven by Raines on Aug. 21, 2011, while she swam in Pineview Reservoir.

The jury got the case about 6:30 p.m. following a day of testimony and closing arguments and deliberated for about 90 minutes before returning with a verdict.

Ex-coach gets 3 months for one-punch death of Roy man in Vegas casino

LAS VEGAS — A former high school football coach and teacher from Florida was sentenced to three months in jail and ordered to pay a $5,000 fine Thursday after being convicted of involuntary manslaughter in the one-punch death of a Utah man at a Las Vegas casino.

Defense attorney Jack Buchanan said he didn’t believe a punitive stint in the Clark County Detention Center was appropriate for his client, 39-year-old Benjamin Gerard Hawkins, of Gainesville.

Hawkins has remained free following his November conviction in the death of 46-year-old John Massie, an occupational safety and health worker at Hill Air Force Base.

DEA handler testifies to Ogden's help in large drug bust, FBI indifference

SALT LAKE CITY — Wayne Ogden’s DEA handler testified to his major help in a large club drug bust, as well as the FBI’s indifference to his offers to do the same for mortgage fraud.

Gerald Kaphing of the DEA is a keystone in the defense’s case begun Tuesday at former Weber County swindler Ogden’s federal fraud trial. The trial began Jan. 23 and could go to the jury by the end of the week, although it is scheduled for several days next week before Judge Clark Waddoups.

Kaphing is currently a senior inspector in the DEA’s Washington, D.C., headquarters after 17 years as an agent working in numerous locations around the country, including five years in the Salt Lake office from 1999 to 2004.

Plaintiffs: Kick Ogden's attorneys off 2005 fatal-crash case

OGDEN — The nearly seven years of litigation over a fatal car crash that followed a police chase continues with plaintiffs seeking to have Ogden city’s lawyers kicked off the case.

A faulty line of questioning by the city’s hired lawyers during a November 2009 trial caused the Utah Supreme Court last June to throw out the jury verdict that had acquitted the city.

The justices ordered a new wrongful death trial in the 2005 crash in which two people died.

Wife, daughter of former Ogden councilman/Reagan appointee guilty of mishandling trust fund

OGDEN — Alex Hurtado would be chagrined at what has become of his legacy as family members wrestle over the trust fund he left behind.

A 2nd District Court jury in Ogden recently found his wife and daughter guilty of mishandling the trust fund, delivering a $341,770 judgement against them. The suit was brought by Hurtado’s brothers and sisters and other relatives in 2007.

Hurtado died of a heart attack in 2004 at age 70 after a distinguished civic and political career that included serving in the Reagan White House, eventually as the national director of Hispanic affairs in the Reagan presidency.

FARMINGTON — A teenage couple who police say held a 50-year-old man hostage for 12 hours in his own home entered not guilty pleas to kidnapping and robbery charges.

Layton man accused of punching woman arrested after skipping court hearing

SUNSET — A Layton man accused of punching a female employee in the face at a Salt Lake City haunted house failed to appear for a court hearing in December.

Angelo Demetry Apadaca, 26, was arrested by Sunset police late Friday night and booked in Davis County Jail early Saturday morning. He is being held in lieu of $25,000 bail out of 3rd District Court.

Apadaca is charged with aggravated assault, a second-degree felony. He is accused of punching a woman in the face at the Nightmare on 13th Street on Oct. 6.

Trial canceled for Kaysville man who fatally shot father; new hearing set

FARMINGTON — Attorneys say they need more time to prepare for the trial of a man who shot his father in 2011.

Defense attorney Todd Utzinger said his office “is still looking into all of the background” concerning Gregory Nance, 52, who was shot March 19, 2011, by his son Joseph Allen Nance.

Joseph Allen Nance is charged with first-degree felony murder and third-degree felony possession of a firearm by a restricted person.
