Trial set for man whose conviction was overturned

SALT LAKE CITY -- A second trial has been set for a man whose murder conviction in the 2002 shooting death of another man outside a Salt Lake City nightclub was vacated by the Utah Supreme Court.

A trial for 34-year-old Deon Lomax Clopten is scheduled to start Aug. 2.

The high court ruled in December that the trial court should not have excluded expert testimony about the reliability of eyewitnesses.

Clopten maintained that another man was responsible for the shooting and hired an expert to testify about the potential problems with eyewitness identification.

But a judge refused to allow the expert to testify and instead warned about the dangers of eyewitness testimony with a jury instruction.
