Trece injunction hearing postponed

OGDEN -- Tuesday's hearing on the continuing constitutional debate over the Ogden Trece gang injunction has been postponed until January.

The injunction ordered into law Sept. 27 by 2nd District Judge Ernie Jones bans the gang's members from associating in public, being in the vicinity of guns, drugs and alcohol, or staying out past an 11 p.m. curfew.

Defense lawyers and the ACLU of Utah have challenged the injunction on constitutional grounds, motions now on hold until Jan. 3 before Jones with the scheduling conflicts of the large number of attorneys involved. They also wait on word whether the Utah Supreme Court will entertain arguments appealing Jones' granting the injunction.
