Federal court upholds conviction of Brigham City doctor

SALT LAKE CITY — A federal appeals court has upheld the conviction of a Utah pain doctor on drug charges but sent the case back to a federal judge to clarify his sentence.

SALT LAKE CITY — The courtroom intrigue continues as Weber County’s Wayne Ogden claims he was working undercover when he concocted the fraud case he is now charged with in federal court.

He was running his own private sting on behalf of the Drug Enforcement Administration, according to Ogden’s defense team, a claim it presented during opening arguments of Ogden’s three-week fraud trial.

And he not only worked with the DEA, but the FBI, federal housing regulators and state securities investigators as well, the team says.

Grand jury indicts Kaysville smoke shop owner, associate after spice bust

KAYSVILLE — The owner of a Davis County smoke shop, who police say is linked to the Iraqi Mafia gang, has been indicted by a federal grand jury in connection with a $60,000 spice bust.

The undercover bust was carried out in November by the Davis Metro Narcotics Strike Force and the U.S. Drug Enforcement Administration.

The indictment, unsealed Friday, charges Adel Al-Mukahel, owner of Victor’s Smoke Shop in Kaysville and VIP Smokes and Hookah in South Jordan, and his associate, Hani Al-Saimari, with the following offenses:

Ogden man's $53 trillion false lien case ends in guilty plea

SALT LAKE CITY — Ogden constitutionalist Harvey Goff has pleaded guilty in a plea bargain to federal charges stemming from traffic stops in Ogden almost two years ago.

Goff, 55, was indicted in May 2011 for a scheme that amounted to fraud after he filed more than $53 trillion worth of liens against public officials, including two Ogden judges, involved in prosecuting the 2010 speeding citations.

One of the minor traffic cases turned into a felony charge of impersonating a public official when Goff claimed to have immunity as some kind of diplomatic agent of the U.S.

That case is still pending in Ogden before 2nd District Judge Michael Lyon, delayed by Goff’s multiple pro se filings in the case.

Court declares Defense of Marriage Act unconstitutional

A federal appeals court on Thursday ruled that the Defense of Marriage Act is unconstitutional because it denies equal rights for legally married same-sex couples, making it likely that the Supreme Court will consider the politically divisive issue for the first time in its next term.

The decision by a unanimous panel of the U.S. Court of Appeals for the 1st Circuit in Boston was a big win for President Barack Obama, who recently said he supported states allowing gay men and lesbians to marry.

Former Box Elder County sheriff's deputy pleads not guilty to federal illegal search charges

SALT LAKE CITY — Former Box Elder County Sheriff’s Deputy Scott R. Womack pleaded not guilty Wednesday to eight misdemeanor federal counts of depriving women of their rights.

The charges, announced earlier in the day by the U.S. Attorney’s Office, stem from incidents in which Womack is alleged to have had illicit contact with female motorists he stopped.

SALT LAKE CITY — An Ogden man was sentenced to 25 years in federal prison Thursday for photographing himself having sex with a 9-year-old in 2010.

Federal judge dismisses Utah liquor lawsuit

SALT LAKE CITY — A federal judge dismissed a lawsuit Monday challenging Utah’s prohibitions on drink specials and limited bar licenses unless the attorneys for bar and restaurant owners clarify their arguments.

U.S. District Court Judge Bruce Jenkins gave the Utah Hospitality Association 20 days to amend its lawsuit but made it clear the lawsuit cannot proceed without stronger evidence about the negative impacts on businesses.
