Bill allows name removal from gun access list

SALT LAKE CITY — If a bill that cleared a Senate committee becomes law, a person who has dealt with mental illness but has been found to be healthy may petition the courts to be removed from a database restricting their access to a firearm.

SB 80, sponsored by Sen. Daniel Thatcher, R-West Valley, received a favorable recommendation in committee and advances to the full Senate.

The bill outlines a process a person whose name is on the National Instant Check database may follow to have their name removed.

Utah lawmakers: Gun control a federal vs. state rights issue

SALT LAKE CITY — The gun battles of this legislative session may come down to the question of state versus federal control.

Utahns enjoy broader firearms protection than most states provide, thanks to a clause in the state constitution that goes beyond guaranteeing the right to bear arms and also secures that right for the “security, and defense of self, family and others.”

That control is unlikely to be changed significantly this legislative session, say a number of lawmakers. But what if the federal government intervenes with new gun-control laws?

Therein would lie a major battle.

'Obamacare' includes provision protecting gun rights

Did you know the Affordable Care Act stands up for gun rights? The “Protection of Second Amendment Gun Rights” section says the health law’s wellness programs can’t require participants to give information about guns in the house. It also keeps the Department of Health and Human Services from collecting data on gun use and stops insurance companies from denying coverage or raising premiums on members because of gun use.
