Judge rejects Stewart defense claim that death penalty is unconstitutional

OGDEN — A judge has rejected a defense motion calling for the death penalty to be declared unconstitutional.

Filed as part of the run-up to Matthew David Stewart’s trial in a police shooting, it is the first of several constitutional challenges expected in any death penalty case.

Stewart is charged with capital homicide in the Jan. 4, 2012, police pot raid gone bad that left officer Jared Francom dead and five other officers and Stewart injured.

Stewart files motion to suppress search warrant that allegedly led to shootout

OGDEN — Matthew David Stewart’s defense team has filed a motion to suppress the search warrant that led to a deadly shootout with police at his home on Jan. 4, 2012.

The 142-page motion would only apply to the 16 marijuana plants seized by police after five officers were wounded and Agent Jared Francom killed, for which Stewart now faces the death penalty.

Stewart to face murder trial in April 2014

OGDEN — Trial has been set for next year for Matthew David Stewart in the shootout with police at his home that left one officer dead and five injured.

Stewart faces the death penalty if convicted in the fatal shooting of officer Jared Francom. He is also charged with seven counts of attempted aggravated murder for allegedly shooting at seven other officers, hitting five.

OGDEN — Jared Francom was the last officer hauled to safety from the Jan. 4 search warrant-turned-gun battle, carried a half block to an ambulance that couldn’t come closer to the crime scene because bullets were still flying from 3268 Jackson Ave.

Even after six wounded agents of the Weber-Morgan Strike Force had been removed from the home by fellow officers, the ordeal continued on the street in front of the home, bullets bouncing off asphalt.

The whole incident lasted about 25 minutes, from the time officers knocked down a door to serve a drug-related search warrant until Matthew David Stewart was in custody.

Defense attorney: Stewart search warrant sure to raise questions with jury

OGDEN — The search warrant that brought police to the door of Matthew David Stewart’s home only to end up in a shootout will likely gain more scrutiny as Stewart’s prosecution proceeds.

The Jan. 4 gunfire left one officer dead and wounded five other officers, as well as Stewart.

Shoes a big topic in Day 3 of hearing; Stewart going before jury

OGDEN — In something of an anticlimax with the many admissions to the shootings, Matthew David Stewart was ordered bound over for trial on all charges in a Jan. 4 shootout with police.

Second District Judge Noel Hyde set arraignment for Wednesday in concluding Stewart’s three-day preliminary hearing Friday.

Stewart, 38, faces the death penalty if convicted in the shooting death of officer Jared Francom, 30. Stewart is also charged with shooting at seven other officers that night, wounding five.

Stewart and his family members have claimed in the media he did not know the nine members of the Weber-Morgan Narcotics Strike Force who entered his home at 3268 Jackson Ave. with guns drawn, serving a marijuana warrant, were police.
