SALT LAKE CITY -- Court records show a former state senator who resigned after an arrest on suspicion of driving under the influence is scheduled for a March court appearance.
Sheldon L. Killpack is charged with class B misdemeanor driving under the influence of alcohol or drugs and class C misdemeanor failure to signal.
Arraignment is set for March 23 in Salt Lake County Justice Court.
Defense attorney Edward K. Brass has entered pleas of not guilty to both counts on Killpack's behalf.
If convicted, the former Republican Senate majority leader faces a possible combined penalty of up to nine months in jail.
Killpack was pulled over and arrested by a Utah Highway Patrol trooper on Jan. 15.
Court papers allege a test found Killpack's blood alcohol level was .11, above the legal limit of .08.
