SALT LAKE CITY -- A competency hearing for the man charged with Elizabeth Smart's 2002 abduction is moving into its eighth day.
Evidence presented during the 10-day U.S. District Court hearing for Brian David Mitchell will inform a judge's decision on whether Mitchell can stand trial.
The former street preacher is charged with kidnapping and unlawful transportation of a minor across state lines.
Defense attorneys called their first witness on Tuesday. Dr. Stephen Golding says Mitchell is incompetent and has a delusional disorder.
On Wednesday the defense is expected to cross-examine the prosecution's key witness, Dr. Michael Welner.
Welner contends that Mitchell is a pedophile who has some mental disorders. But he says Mitchell is faking incompetence to avoid prosecution.
