Layton man charged with harboring, repeatedly raping underage runaway

LAYTON — Prosecutors on Wednesday charged a Layton man with multiple child rape and sodomy counts after he allegedly took in a 13-year-old runaway from October through January.

Edgar Urrutia-Gonzalez, 21, allegedly befriended the girl in October and she ran away from home, accepting his invitation to live with him, according to charging documents. The girl’s parents reported her missing, prompting a Layton Police Department investigation.

A probable cause statement filed in 2nd District Court said the girl told police the two allegedly had sexual intercourse and sodomized one another numerous times during the three months she stayed with him. She told detectives that Urrutia-Gonzalez did not use condoms “because he was actively trying to impregnate her,” charging documents said.

Police said they were able to locate the girl by tracing her social media activity.

The Davis County Attorney’s Office charged Urrutia-Gonzalez with four counts of rape of a child and three counts of sodomy on as child, all first-degree felonies, and class B misdemeanor harboring a runaway. Convictions on the felony charges would carry penalties of 25 years to life in prison.

Police said Urrutia-Gonzalez knew the girl was 13 years old, adding that the girl told them he “constantly reminded (her) that they needed to be careful because he would be in trouble if they were caught.”

Urrutia-Gonzalez was not in custody as of Wednesday morning. Prosecutors filed a motion in 2nd District Court asking that he be held without bail when he is arrested. Prosecutors argued Urrutia-Gonzalez is a danger to the community. They said he was deported in 2019 and ordered not to reenter the United States.
