Ogden man who shot cousin’s ex-boyfriend gets year in jail

OGDEN — An Ogden man has received a suspended prison sentence and will serve a year in jail for a shooting that seriously injured his cousin’s former boyfriend.

Originally charged with first-degree charges of aggravated assault and aggravated burglary, Dario Muniz, 33, pleaded guilty in December to a reduced charge of second-degree felony aggravated assault. In return for the plea, Weber County prosecutors dropped the burglary charge.

Ogden police said in charging documents that Muniz came to the aid of his cousin, Bailey Chase, who was in a dispute with an ex-boyfriend on June 4, 2021. Investigators said the two went to the 33-year-old victim’s apartment to confront him. Police said Muniz hit the victim with a rifle, then shot him in the abdomen.

In 2nd District Court on Feb. 10, Judge Joseph Bean sentenced Muniz to two to 20 years in state prison but suspended the sentence. He then sentenced Muniz to a year in the Weber County Jail, giving him credit for 41 days served, and pronounced a 48-month probationary period.

Chase, 21, of Harrisville, who also took a plea bargain, was sentenced in October to a suspended prison term of one to 15 years and ordered to instead spend a year in the Weber County Jail.
