Neurosurgeon charged with squeezing patient’s breasts during surgery

OGDEN — A neurosurgeon has been arrested after operating room personnel told police the doctor allegedly grabbed an unconscious patient’s breasts during surgery while talking about his sexuality.

Bryson Swain Smith, 65, was booked into the Weber County Jail on Thursday on suspicion of two counts of class A misdemeanor sexual battery stemming from a surgery at Ogden Regional Medical Center on Oct. 21, 2021.

Charging documents said a member of the surgical team reported that Smith was taking about his upcoming retirement “before changing the subject to inappropriate subjects such as ‘swinging’ and his sexuality.”

The staff member reported Smith allegedly said, “I swing both ways, which is why I can do this,” and allegedly squeezed both of the unconscious patient’s breasts, which were covered by a thin surgical sheet. “And this,” he allegedly said while reportedly making a circular motion over his genitals. The staff member said Smith paused and said, “Uh, no one report me for that.”

A second staff member said he saw Smith grab the woman’s breasts. The employee told deputies that no one in the room said anything “due to the shock of witnessing the incident.”

Later in the surgery, the first staff member said, Smith allegedly patted his wrists on the woman’s breasts and said, “it’s a good thing she has these nice pads here that I can rest my hands on.”

A third staff member told investigators that he did not see an assault but heard Smith allegedly say, “Please don’t report me to HR.”

When asked about the case on Monday, MountainStar Healthcare, parent company of Ogden Regional, issued the following statement:

“The hospital takes allegations of this type very seriously. Upon learning about this allegation involving an affiliated physician, the hospital immediately investigated and closely followed hospital policies and protocols, including notifying the patient and making reports to law enforcement and appropriate agencies. The physician is no longer a member of our medical staff.”

Smith, of Farmington, was taken into custody at his home by Weber County Sheriff’s Office deputies. Smith was no longer in custody on Monday and formal charges had not yet been filed. Efforts to reach Smith were unsuccessful and he did not have an attorney of record.
