FARMINGTON — A judge has sentenced a Layton man to prison on reduced charges for a sudden suffocation and strangulation attack on his mother.

In a plea bargain, Jacob Raoul Solis, 36, pleaded guilty in July to second-degree felony aggravated assault and second-degree felony aggravated burglary. The Davis County Attorney’s Office in return dropped charges of first-degree felony attempted murder, firearms and drug paraphernalia possession charges, and three counts of domestic violence in the presence of a child.

Second District Judge David J. Williams on Monday ordered Solis to spend concurrent terms of 1 to 15 years at the Utah State Prison on the assault and burglary charges. Solis was given credit for time served in the Davis County Jail since his arrest after the Sept. 19, 2020, incident.

Solis was eating breakfast at his mother’s home in Layton on Sept. 19, 2020, when he began acting oddly and then attacked her, but she got free as two young grandchildren came to her aid, according to Layton Police Department charging documents.

Layton police said Solis told his mother that “he was involved in something big and that he could not tell her what it was or it would put her in danger.” Then Solis “suddenly came up behind her and put a plastic bag over her head, pulling tightly on the bag so that she could not breathe.”

Solis’s mother was able to tear a hole in the bag to regain her breathing, but her son then put her in a choke hold, again restricting her airway, according to the arrest affidavit. The woman’s 12-year-old granddaughter hit Solis with a stick and an 11-year-old grandson tried to stab him with a tool, according to police.

Solis went outside to his car and the woman and children locked and barricaded the door. They told police he returned to his mother’s mobile home and kicked and banged on the door. They also saw that he had a handgun in his waistband, the arrest affidavit said.

Solis eventually left, and police found him later that day in his car. Officers said they searched the vehicle, finding a .22 caliber handgun and a methamphetamine pipe.
