Suspect arrested in Ogden man’s shooting death

WEST VALLEY CITY — Police have arrested a suspect in the Dec. 27 shooting death of an Ogden man at a West Valley City apartment complex.

The West Valley City Police Department said in a social media post that Dylan Upshaw, 21, was arrested Tuesday evening on suspicion of fatally shooting Xavier Bernal, 20. A police arrest affidavit said Upshaw was taken to the Salt Lake County Jail on suspicion of first-degree felony aggravated murder and second-degree felony obstruction of justice.

The affidavit said Bernal had gone to Redwood Apartments, 4000 S. Redwood Road, where Upshaw lived, to meet with him. Bernal was shot and others drove him to a local hospital, where he died.

West Valley detectives identified Upshaw as a suspect, and police on Saturday asked the public for help in locating him. On Tuesday, police got a tip that Upshaw was at a Salt Lake City hospital with his girlfriend.

Upshaw declined to speak with detectives, the arrest affidavit said. Formal charges had not been filed by Wednesday afternoon.
