New charges: Altice sexted, had sex with teen
FARMINGTON — A teenage boy has claimed he had sex with Brianne Altice after she was initially arrested.
Altice, 35, was booked in the Davis County Jail on Wednesday and was released after posting $10,000 bail. She is charged in 2nd District Court with three counts of unlawful sexual activity with a minor and one count of dealing in material harmful to a minor. The charges were filed on Tuesday.
According to the arrest warrant filed in 2nd District Court, Altice is accused of having sexual intercourse on two different occasions and oral sex with a 17-year-old boy between Nov. 1, 2013, and Aug. 25, 2014. She is also accused of sending the teenager a text message with a photograph of her nude breasts on June 7, 2014.
The Davis County Attorney’s Office asked in the arrest warrant that Altice be held without bail because she was already facing felony charges in a case that was filed in 2013.
No court date has been set for this case.
Altice is expected to be in court for a preliminary hearing on Jan. 15 on other previous charges, according to the court website. Prosecutors filed an amended information document with an additional rape charge on Nov. 4, 2014, in a case that was filed in 2013. According to the court document, Altice is accused of having sex with a person without their consent sometime between Aug. 1, 2013, and Sept. 30, 2013. By law even though a student may be 16 or 17 years old, they cannot give consent to have sex with their teacher.
She has already had two other preliminary hearings. During those hearings two other former students testified in court about their alleged sexual relationship with Altice, who taught English at Davis High School.
Altice is charged in the 2013 case with five counts of rape, two counts of forcible sodomy and three counts of forcible sexual abuse. She was originally charged with three counts of rape and one count of forcible sodomy.
The first preliminary hearing was held in February 2014. The first student who spoke with police about having a sexual relationship with Altice testified at that hearing.
A preliminary hearing where a second former student described his relationship with Altice as a ”teacher with benefits” was held in September.
Both of the students who testified are now adults. It is the policy of the Standard-Examiner not to publish the names of people who are considered victims of sex crimes.
Altice was arrested in October 2013 by Layton police.
Altice’s attorney, Ed Brass, wants the court to suppress statements Altice made to police when she was arrested at her home in October 2013. A motion hearing on the issue has been canceled.
State Office of Education officials said that in 2004, Altice was hired as a prep-time specialist at Wasatch Elementary School, a part-time job. In 2005, she transferred to Sunset Junior High School, where she taught English. In August 2012, Altice was transferred to Davis High School to teach English. She no longer teaches at Davis High.
