Attorney wants victim’s mental health records in Woods Cross sex case

FARMINGTON — The attorney for a 27-year-old woman accused of having sex with a 16-year-old boy has filed a motion asking for the teen’s mental health records.

Brenda Elkface appeared in 2nd District Court on Wednesday, June 22, with her attorney Danny Frazier. She is accused of having sex with the boy who was a patient at Benchmark Behavioral Health Systems in Woods Cross where she was a mental health worker. 

Woods Cross police said they were contacted when a 16-year-old boy reported he had sex with Elkface.

She is charged with two counts of rape, two counts of forcible sodomy and one count of forcible sexual abuse.  She entered not guilty pleas to the charges on Aug. 19. The first four charges carry a life sentence if Elkface is convicted.

Frazier filed a motion seeking the mental health records in March. Frazier claims in the court document that the boy has a history of making false allegations. He also wrote in the document that the records he is requesting are sensitive and are not available to the public.

It is the policy of the Standard-Examiner not to identify victims in sex cases. 

Deputy Davis County Susan Hunt said she plans to file a motion this week objecting to the request.

Another hearing for oral arguments concerning the motion is scheduled for 3:30 p.m. July 27 before Judge David Hamilton.
