Final ATM robbery plot suspect pleads guilty to felony aggravated robbery

OGDEN — The third and final suspect in a conspiracy to assault and rob an ATM technician has pleaded guilty to a robbery charge.
Rainier Adam Such, 32, and his attorney Randall Richards appeared in 2nd District Court Tuesday morning in front of Judge Jennifer Valencia.
Such pleaded guilty to aggravated robbery, a first-degree felony, as a part of a plea agreement that included the dismissal of two other charges: attempted theft and burglary, both second-degree felonies.
Such is scheduled to be sentenced Dec. 11 in Ogden. Such has been out on bail since December 2016.
Such is one of three suspects in a robbery scheme in October and November 2016 where the group planned to use a Taser to attack an ATM technician, steal his keys and steal money from the machine, according to an investigation by the Utah Attorney General’s Office.
The plan was thwarted after a fourth person involved in the planned robbery alerted police to the group’s plan. The name of the fourth member of the group has never released.
Prior to the failed robbery, all four members of the group attempted to steal an ATM from the lobby of a Plain City credit union, but were unsuccessful.
Kacy Peterson, one of the three charged in connection to the plot, agreed to a plea bargain on June 6, which included Peterson pleading guilty to one count of aggravated robbery, a first-degree felony.
As of Tuesday afternoon, Peterson is being held at the Utah State Prison and does not have a parole date set.
The third group member, Ashlee Hales, pleaded guilty to a second-degree felony charge of attempted theft, and agreed to testify against the other defendants, state prosecutors said in court documents. In return, state prosecutors dropped four felony charges against Hales.
Hales is scheduled to face sentencing on Dec. 18.
