West Haven woman sentenced in child abuse death of Gavin Peterson

OGDEN — Nichole Lea Scott, the stepmother of Gavin Peterson, was sentenced Monday in the July 2024 child abuse death of the 12-year-old boy in West Haven.

Scott, 51, who pleaded guilty to a litany of charges last month, was sentenced in Ogden’s 2nd District Court by Judge Camille Neider. For her guilty plea to first-degree murder, Scott was sentenced to 15 years to life in the Utah State Prison.

The other sentences handed down — which will be served consecutively, along with the sentence for murder — include two terms of one to 15 years for second-degree aggravated child abuse, two terms of one to 15 years for second-degree obstruction of justice, up to five years for third-degree child endangerment and up to one year for possession of a controlled substance.

Scott was given credit for 292 days served. The court recommended that she remain incarcerated “for the rest of her natural life.” Multiple victim impact statements were filed for judicial review.

Monday’s sentencing follows the sentencing last week of Peterson’s father, Shane Jesse Peterson, who pleaded guilty to multiple charges in March. The 47-year-old was ordered to serve five years to life for first-degree reckless child abuse homicide, three terms of one to 15 years for second-degree aggravated child abuse and up to five years for third-degree child endangerment — sentences that will similarly be served consecutively.

Meanwhile, Gavin Peterson’s stepbrother, Tyler Shane Peterson, is due back in court May 22 for a review of treatment after the 22-year-old was found to be suffering from psychological disorders.

The probable cause affidavit stated that deputies were dispatched to Scott and Shane Peterson’s West Haven residence on the afternoon of July 9 following a report of an unresponsive male child. According to the affidavit, the caller reported that the child “had been ill for several days, experiencing vomiting, and was now not breathing.”

Upon arrival, the first deputy on scene took over CPR from family members on the bathroom floor, per the arrest document. Gavin Peterson was transported by medical personnel to a nearby hospital, where he was later pronounced dead. A subsequent examination revealed that Peterson had suffered from severe malnutrition, his internal organs having “shut down completely.” The child’s body was also described as visibly emaciated.

Search warrants executed on the phones of Scott, Shane Peterson and Tyler Peterson resulted in the discovery of text messages that referenced “hitting or beating the child,” according to the affidavit. There were also references to keeping the child locked in his room and providing him with very little food or water, “or not feeding him food at all.”
