Pool party turns violent, 2 police officers assaulted

SOUTH OGDEN — A partygoer allegedly pushed a South Ogden police officer into a swimming pool and hit another in the face, breaking his glasses, as they attempted to arrest him during an assault investigation, charging documents said.

The brawl happened at about 2 a.m. Saturday after a person at the residential party called police and officers encountered Rigoberto Avila-Garcia, 30, in the backyard by the pool. An arrest affidavit said Avila-Garcia and a woman had been arguing and she got into the swimming pool. He allegedly threw a wood table and chair at her in the pool. He then allegedly turned over a glass table, shattering it.

When police arrived, they said they tried to talk to Avila-Garcia and he yelled at them and allegedly resisted when they moved to detain him. After the two alleged assaults against officers, he was subdued and taken to the Weber County Jail.

The arrest affidavit said Avila-Garcia denied throwing the furniture at the woman but admitted the glass table broke when he kicked it, according to the arrest affidavit.

Avila-Garcia was ordered held without bail on suspicion of domestic violence-related aggravated assault and two counts of assault by a prisoner, all third-degree felonies, plus misdemeanor charges of interference with an arresting officer, criminal mischief and intoxication.
