Layton man charged in 2021 shooting that seriously injured Harrisville woman

HARRISVILLE — A Layton man has been charged after an investigation into an Aug. 28, 2021, shooting that left a woman with serious injuries.

Charging documents filed in 2nd District Court on Monday described the circumstances of the incident at the woman’s Harrisville home. Austin Chalk, 35, is charged with second-degree felony aggravated assault resulting in serious bodily injury and class B misdemeanor carrying a dangerous weapon while under the influence of alcohol.

According to the charges, the pair had guns, beer and wine on the kitchen table. The woman grabbed a Nerf gun and shot him several times. He grabbed his Ruger and shot her in the abdomen, puncturing her uterus, bladder and intestine.

Harrisville police responding to a 911 call about a reported accidental shooting said they found the woman in a bathroom, the man applying pressure to an abdominal wound. The woman was taken by ambulance to a hospital to undergo life-saving surgery. She ended up requiring several surgeries to repair the damage.

On the table, police saw two handguns, boxes of ammunition, loose ammo and various alcohol containers. They said Chalk told them he had been cleaning guns. Police said they did not see any gun-cleaning supplies.

Chalk appeared to be intoxicated and during questioning “he was unable to keep a clear train of thought and kept repeating himself,” the charging documents said. Police said they gave Chalk a breath test and it registered .306% blood alcohol content.

The woman told police at the hospital the next day that Chalk arrived at her home just after midnight with a six-pack of beer. She said Chalk “wasn’t supposed to be drinking because he couldn’t handle it at all.”

She said he put his Ruger on the table and she got out her firearms to show them to him. She then got out some Nerf guns, joked with Chalk and began shooting him. He then allegedly said, “Oh, really, is this how it goes,” grabbed his real gun “super fast” and pulled the trigger.

According to court records, Chalk will be issued a summons to make an initial appearance before an Ogden judge on Jan. 9. Chalk was not in custody and did not have an attorney of record as of Wednesday.
