OGDEN — The two suspects in the March 14 killing of Robert Bien on an Ogden street, including the minor and apparent suspected gunman, have been formally charged with aggravated murder in the case.

What’s more, the minor — Charli Ortega Delgadillo, 17 — faces charges in 2nd District Court as an adult, same as the other suspect, Hugo Zamora, 26. By state law, 16- and 17-year-olds charged with murder are to be tried in district court, Weber County Attorney Chris Allred said Monday.

Ortega and Zamora, both of Ogden, are accused in the death of Bien, shot and killed around 3 a.m. on March 14 in the 2900 block of Childs Avenue, where he was walking, allegedly after rebuffing the two suspects’ attempts to rob him, according to authorities. According to a probable cause statement, Bien was walking with another individual when Ortega and Zamora, in a vehicle, happened upon them and attempted to rob them. Ortega, 16 when the incident occurred, allegedly took $60 from the other person.

Zamora was allegedly the driver of the vehicle and Ortega was a passenger. Zamora said Ortega had been “on the ground with another individual” when he heard shots go off, according to the probable cause affidavit. “Hugo advised that Charli ended up getting back into his vehicle and they then left the scene,” the document reads.

In addition to aggravated murder charges, filed on May 4, Ortega and Zamora face aggravated robbery, obstructing justice and firearms charges. Neither had an attorney of record listed in charging documents as of Monday and both are being held without bail.

According to the affidavit in the case, officials on April 10 found shell casings at Harold Crane Waterfowl Management area in Box Elder County that matched casings collected at the scene of Bien’s killing. During a search of Ortega’s home, investigators found two 9 mm shell casings. Authorities recovered 9 mm casings at the scene of Bien’s killing as well.
