SALT LAKE CITY -- Attorneys for the former street preacher sentenced to life in prison for kidnapping and raping Elizabeth Smart say they won't appeal his conviction.
Utah Federal Public Defender Robert Steele says Brian David Mitchell does not want to file an appeal. Steele says he can't discuss the 57-year-old Mitchell's decision in more detail.
Monday was the deadline for filing an appeal on Mitchell's behalf.
A federal jury in December unanimously convicted Mitchell on charges of kidnapping and unlawful transportation of a minor across state lines for the purpose of illegal sex.
A judge sentenced Mitchell to two life sentences.
Smart was 14 in 2002 when she was taken at knifepoint from her Salt Lake City bedroom, raped and held for nine months until she was found in March 2003.
